Legal Basis
The Recycling Regulation, under the Environmental Management Act, provides a single results-based framework for EPR in B.C with an emphasis on environmental outcomes and program performance. It includes core requirements applying to all producers and programs for each product category covered by the regulation. The regulation may be expanded to include a new product category through the addition of a schedule for that product or material. To date, the following waste streams have been designated under the Recycling Regulation:
- Beverage containers
- Residual products: pesticides, solvents, flammable liquids, pharmaceuticals, gasoline, Lubricating oil, Empty oil container, oil filters, paint, Lead-acid battery, antifreeze
- Electronic and Electrical Products : waste electronics, smoke detectors, small appliances, large appliances, all batteries, light bulbs
- Tires
- Packaging and Printed Paper
The framework Recycling Regulation requires all product stewardship plans to achieve (or be capable of achieving) a 75 percent recovery rate within a reasonable time.
Producers, or their agency, are required to submit to the ministry and post on their website an annual report detailing the environmental performance of their program and if applicable independently audited financial statements.
The B.C. Ministry of the Environment reviews annual reports and approves stewardship plans, provides assistance to producers in understanding the requirements of the Regulation, and carries out compliance and enforcement actions where necessary.
