Legal Basis
Ukrainian Law ‘On Waste’(1998) formulated main legislative principles and policies in waste management sphere, defined responsibilities and controls, laid implementation mechanisms.
Article 9 Subjects of Waste Property Rights :
territorial communities shall be owners of wastes produced by municipal property or premises occupied by it, which have no established owners or whose owners are unknown
Article 17 Obligations of the Subjects of Business Activity in the Sphere of Waste Management:
d) to implement the complete collection, right storage and non-admission of destruction and damage of the waste;
p) to provide utilization or export of used packing materials and tare from Ukraine signing the agreement about delivery of commodity output to Ukraine.
As to the Resolution of the Cabinet of Ministers No. 915 of 26.07.2001 (changes of 25.07.2002 No.1069, of 26.07.2002 No. 1084, of 26.11.2003 No.1844, of 17.03.2004 No. 324):
- manufacturers and importers of the packed goods must pay for 100% utilization of packaging marketed in Ukraine;
- created the conditions to monopolize the market of the services payment by the one state ‘Ukrecocomresursy’ company.
